Sign-On Bonus Tax
Sign-on bonus is fully taxable in the year received. If you leave within the clawback period, you typically refund the gross amount — even though you paid tax on it. Most employers don't adjust the TDS on clawback.

The math you actually pay
A sign-on / joining bonus is taxable as salary in the financial year it's credited — employer deducts TDS upfront (usually at your marginal slab). Clawback clauses typically force you to refund the gross amount, not the post-tax in-hand, if you leave within 12 or 24 months. Most employers will not revise the TDS or issue a fresh Form 16 — you have to claim the refund yourself by filing a revised return or claiming as “refund of salary” in the year of clawback.
Worked example
Offer letter: ₹5,00,000 joining bonus with 12-month clawback. Your marginal slab is 30% + 4% cess = 31.2% effective. Post-tax cash in hand: ₹3,44,000. If you exit at month 8, the typical clawback is pro-rata (4/12 retained) — you owe ₹3,33,333 back gross. You only have ₹3,44,000 in your account, so the bonus net of clawback is just ₹10,667. To recover the ₹1,04,000 tax already paid, file Form ITR with the clawback shown as “recovery of bonus” in the next return.

Can I negotiate clawback duration?
Often yes. Standard is 2 years; sometimes pro-rated (50% if you leave in year 1, 25% in year 2). Always read the offer carefully.
Tax refunded on clawback?
You can claim deduction in the year of clawback under section 71 / 72. Get a written confirmation from the employer (Form 16 reissue or letter).
Is sign-on bonus part of CTC?
Sometimes — especially in tech offers. A ₹50L CTC with ₹15L sign-on means base salary of ₹35L. Always clarify the breakdown before signing.
