A POA appoints an "attorney" to act on the principal's behalf. For property matters, registration is mandatory. Stamp duty is state-specific (₹100-₹500 typically).

KNOW ALL MEN BY THESE PRESENTS that I, Ramesh Kumar,
resident of 12, Sector 14, Gurgaon, hereinafter called "the Principal",
DO HEREBY APPOINT, NOMINATE AND CONSTITUTE
Suresh Kumar, resident of 14, Sector 22, Noida, hereinafter
called "the Attorney", to be my true and lawful attorney for the
purposes set out below.
SCOPE OF AUTHORITY:
The Attorney is hereby authorised to manage my flat at A-501, Sunshine Apartments, Bangalore — including collecting rent, paying maintenance, and dealing with the resident welfare association.
The Attorney shall further be authorised to sign all such papers and
do all such acts as may be incidental to the above purpose, and the
acts of the Attorney shall be binding on me as if done by me personally.
This Power of Attorney shall remain in force until revoked in writing
by me.

A Power of Attorney is governed by the Powers-of-Attorney Act, 1882 and stamped under the relevant State Stamp Act. A General POA grants wide authority across multiple matters; a Special POA is restricted to one defined act (e.g. selling a specific flat). For any POA dealing with immovable property worth more than ₹100, section 17 of the Registration Act, 1908 makes registration with the sub-registrar mandatory — otherwise it cannot be relied on in court.
Worked example
A Bangalore-based NRI executes a Special POA in Dubai authorising her brother in Mumbai to register the sale deed of her ancestral flat. The POA is notarised at the Indian Consulate, couriered to Mumbai, and adjudicated by the Collector of Stamps. Stamp duty in Maharashtra is ₹500 for sale-related POA, plus 1% if consideration is mentioned. Registration fee is ₹100. Total outlay: ~₹3,500 vs the cost of flying to India.

FAQ
Does a Power of Attorney need to be registered?
For property-related matters (sale, mortgage, lease > 1 year): mandatory registration. For routine financial / banking POA: notarised is sufficient. Stamp duty is state-specific (₹100-500 typical).
Is general POA still legal in India?
Yes for most purposes, but the 2011 Supreme Court ruling (Suraj Lamp case) restricts using GPA for property *sale*. For property sale, you need a registered Sale Deed — GPA alone doesn't transfer title.
Can I cancel a POA later?
Yes — execute a Deed of Revocation, register it (if original was registered), and notify the attorney plus all relevant parties (banks, registrar, etc.). Without notification, third parties acting on the POA in good faith may still be valid.
