PAN-Aadhaar linking — penalty, how to check, what happens if not linked

PAN-Aadhaar linking is mandatory under Section 139AA. Unlinked PANs become inoperative — refunds, ITR, banking blocked. Here is the cure.

Quick frame: Section 139AA mandates linking of PAN with Aadhaar for all eligible Indians. Original deadline was 30 June 2023. Past that, unlinked PANs become inoperative — refunds withheld, ITR rejected, higher TDS at 20% on most transactions, mutual fund transactions blocked.

How to link (free if before deadlines, ₹1,000 fee if late)

Online via incometax.gov.in:

  1. Go to "Link Aadhaar" on the e-filing portal
  2. Enter PAN, Aadhaar, name as on Aadhaar
  3. Pay ₹1,000 fee (if applicable) under Major Head 0021, Minor Head 500
  4. Submit and OTP-verify

You'll get an SMS / email confirming the link request. Usually processed in 24-48 hours.

How to check status

incometax.gov.in → "Link Aadhaar Status" → enter PAN + Aadhaar → status.

Possible outcomes:

  • "Already linked" — done
  • "Not linked, fee not paid" — pay first then link
  • "Not linked, fee paid" — proceed with linking (fee will reflect within 4-5 days from payment)

Consequences of inoperative PAN

  • ITR cannot be filed
  • Refunds blocked
  • TDS deducted at higher rate (20% for resident; up to 30% for NRI)
  • Mutual fund / equity transactions blocked
  • Bank account > ₹50,000 deposit needs PAN — quoted PAN is invalid
  • NPS, EPF transactions get rejected

Re-activation

After paying ₹1,000 + linking, PAN becomes operative again typically within 30 days from CBDT processing.

Exemptions

The following are exempt from PAN-Aadhaar linking:

  • Residents of Assam, Meghalaya, J&K (no Aadhaar mandate historically)
  • Non-residents (NRIs) — PAN issued to NRIs has different rules
  • Senior citizens above 80
  • Foreign nationals with PAN

If you fall in one of these categories, no penalty / no inoperative status.

NRIs — special note

NRIs do not need to link Aadhaar (they typically can't even enrol for Aadhaar without 182+ days residence). PANs of NRIs marked as "Non-Resident" on the IT portal remain operative without Aadhaar. If your PAN is wrongly tagged as Resident, file Form 49AA correction.

Q: My name on PAN is "Rajesh Kumar Sharma" but Aadhaar is "Rajesh K Sharma" — will it link? A: System tries to match. Minor differences fail; correct one to match the other. Usually update PAN via Form 49A correction (less hassle than Aadhaar).

Q: Can I file ITR without PAN-Aadhaar linking? A: No. Section 139AA makes it mandatory. Inoperative PAN gets ITR rejected.
